Statement from LeftWord Books and Vaam Prakashan on the Maligning of Teesta Setalvad, 25 June 2022

This statement was issued on the morning of 25 June 2022, several hours before Teesta Setalvad was arrested.

Teesta Setalvad is one of India’s most important human rights defenders, a person of great integrity and with an open record. We are proud of having published her memoirs, titled Foot Soldier of the Constitution, in 2017.

Ever since the fires began to smoulder in Gujarat in 2002, Zakia Jafri has waged a heroic battle for justice, not only for her slain husband (former Member of Parliament) Ehsan Jafri, but on behalf of all victims of state-backed violence against Muslims. Teesta Setalvad has, as she documents in Foot Soldier, stood with Zakia Jafri at every step of the way in this fight for justice. During this struggle, Zakia Jafri and Teesta Setalvad have shown the many errors in the Special Investigation Team (SIT) reports and have exposed the lies that have prevented justice from being delivered to the victims and the survivors. Over the years, Teesta Setalvad, her associates, and the organisations that she’s worked with have faced several attempts to besmirch their reputation. Each time, these attempts have failed because they are based on falsehoods.

At LeftWord Books and Vaam Prakashan, we are deeply disappointed by the Supreme Court judgement that not only upholds the SIT narrative of what happened in Gujarat in 2002, but also questions Teesta Setalvad’s motives with little factual basis. By doing so, the Supreme Court also implicitly undermines Zakia Jafri’s agency and courage.

During her long career, Teesta has followed the legacy of her grandfather, M.C. Setalvad, India’s first Attorney General, and her great-grandfather, Sir Chimanlal Harilal Setalvad, who was the only Indian on the Hunter Commission of Inquiry into the bloody massacre at Jallianwala Bagh in 1919. Like her ancestors, Teesta has an impeccable record of public service and of upholding constitutional values and principles.

India needs more citizens with the courage and fortitude of Zakia Jafri, and more human rights defenders of the calibre of Teesta Setalvad. We stand with them.

तीस्ता सीतलवाड़ की छवि ख़राब करने के प्रयास पर लेफ्टवर्ड बुक्स और वाम प्रकाशन का बयान,

यह वक्तव्य 25 जून, 2022 की सुबह तीस्ता सीतलवाड़ की गिरफ़्तारी के कई घंटे पहले जारी किया गया था।

तीस्ता सीतलवाड़ भारत के प्रमुख मानवाधिकार रक्षकों में से एक हैं। वे अपनी ईमानदारी और बेदाग़ छवि के लिए जानी जाती हैं। हमें गर्व है कि हमने 2017 में उनका संस्मरण संविधान की सिपाही शीर्षक से प्रकाशित किया।

2002 में जब से गुजरात में आग सुलगने लगी, ज़किया जाफ़री ने न सिर्फ़ मार दिए गए अपने पति एहसान जाफ़री( भूतपूर्व सांसद) के लिए बल्कि मुसलमानों के ख़िलाफ़ राज्य प्रयोजित हिंसा के शिकार तमाम पीड़ितों के लिए बहादुरी के साथ लड़ाई शुरू कर दी। जैसा कि तीस्ता सीतलवाड़ नेसंविधान की सिपाही में लिखा है, वह इंसाफ के संघर्ष में हर कदम पर ज़किया के साथ खड़ी रहीं। संघर्ष के क्रम में ज़किया और तीस्ता सीतलवाड़ ने एसआईटी (स्पेशल इन्वेस्टिगेशन टीम) की रिपोर्ट में अनेक खामियों को दर्शाया और उसके उन झूठों को भी उजागर किया जिनके कारण दंगा पीड़ितों तथा हिंसा में बचे रह गए लोगों को इंसाफ नहीं मिल सका। पिछले कुछ वर्षों में तीस्ता सीतलवाड़, उनके सहयोगियों और उनके संगठन को बदनाम करने की कोशिशें की गईं पर वे विफल रहीं क्योंकि वह कवायद झूठ पर टिकी थी।

लेफ्टवर्ड बुक्स और वाम प्रकाशन में कार्यरत हम सब लोग सुप्रीम कोर्ट के उस निर्णय से निराश हैं, जिसमें उसने 2002 की गुजरात की घटना पर एसआईटी के स्टैंड को सही ठहराते हुए मामूली तथ्यों के आधार पर तीस्ता सीतलवाड़ की मंशा पर सवाल उठाए हैं। ऐसा करके सुप्रीम कोर्ट ने निस्संदेह ज़किया जाफ़री के प्रयत्नों और साहस का भी अवमूल्यन किया है।

अब तक के अपने लंबे कार्यकाल में तीस्ता ने अपने दादा और परदादा की शानदार विरासत को आगे बढ़ाया है। गौरतलब है कि उनके दादा एमसी सीतलवाड़ भारत के पहले अटॉर्नी जनरल रहे हैं, जबकि उनके परदादा सर चिमनलाल हरिलाल सीतलवाड़ 1919 के जालियांवाला बाग़ कांड की जांच के लिए गठित हंटर कमीशन के एकमात्र भारतीय सदस्य थे। अपने पूर्वजों की तरह तीस्ता ने भी निःस्वार्थ भाव से और स्वच्छ तरीक़े से समाज की सेवा की है तथा संवैधानिक मूल्यों व सिद्धांतों को स्थापित करने का कार्य किया है।

भारत को बड़ी संख्या में ज़किया जाफ़री जैसे दृढ़ और साहसी नागरिकों तथा तीस्ता सीतलवाड़ की तरह और भी मानवाधिकार रक्षकों की ज़रूरत है। हम उनके साथ खड़े हैं।
